This Affiliate Agreement (the "Agreement") is entered into between [LEGAL NAME], with address at [ADDRESS], [STATE], United States ("the Company"), and the person who registers as an affiliate of El Judicial ("the Affiliate"). By accepting this Agreement the Affiliate confirms having read and understood it, together with the Terms and Conditions and the Income Disclaimer.
1. Free participation
Joining the affiliate program is 100% free. There is no registration fee, no monthly fee and no obligation to buy product in order to join or to remain active. Any purchase the Affiliate makes is a voluntary consumer decision.
2. Independent relationship
The Affiliate is an independent contractor. Nothing in this Agreement creates an employment relationship, a partnership, a joint venture or a franchise. The Affiliate has no authority to sign contracts, make commitments or speak on behalf of the Company, sets their own schedule and covers their own expenses.
3. Commissions
- Commissions are paid only for eligible sales of product. Nothing is paid for recruiting people, and there is no bonus simply for enrolling new affiliates.
- Personal sale: 25%. Level 1: 5%. Level 2: 3%. Level 3: 2%.
- If the Affiliate buys at the affiliate price, that purchase does not additionally generate the 25% personal commission, because the benefit has already been received in the price. When a customer buys at the public price from the Affiliate store, the Affiliate earns the 25%.
- Customer attribution lasts 90 days and restarts with every attributed purchase.
- Commissions stay pending for 30 days before being released, to cover returns and chargebacks.
- Refunded or fraudulent orders reverse the commission for the Affiliate and their upline; if it was already paid, it is deducted from the following payout.
4. Payments
Released commissions are paid once a month, with a minimum balance of 50 USD. If the minimum is not reached, the balance rolls over to the next period. Payments are made in USDT on the BNB Smart Chain network (BEP20). The Affiliate is responsible for providing a correct wallet address; funds sent to an address supplied by the Affiliate cannot be recovered.
5. Prohibited claims
The Affiliate must never make medical claims, must never state or suggest that the product diagnoses, treats, cures or prevents any disease, and must never make income claims, promises of guaranteed earnings or projections of results. Testimonials must be real, personal and presented as individual experiences.
6. Use of the brand
The Affiliate may promote the product using the official materials provided in the affiliate panel. Modifying logos, creating parallel brands, registering confusingly similar domains, social accounts or advertising accounts, or bidding on the brand name in paid search without written authorization is not permitted. Spam, purchased lists, misleading advertising and unauthorized marketplaces are prohibited.
7. Taxes
The Affiliate is solely responsible for declaring and paying any tax on the commissions received, according to the rules of their country and state. The Company may request the tax documentation required by law before releasing a payment.
8. Term and termination
This Agreement is indefinite. Either party may terminate it at any time with written notice. The Company may suspend or close an affiliate account for breach of this Agreement, fraud, manipulation of the referral system, false claims or conduct that damages the brand. On termination the Affiliate loses access to the panel; commissions already released and above the minimum are paid in the next regular cycle, while commissions linked to fraudulent activity are cancelled.
9. Changes and law
The Company may update this Agreement and will announce material changes in the affiliate panel. Continuing to use the program after a change means accepting it. This Agreement is governed by the laws of the State of [STATE], United States. Questions: [CONTACT EMAIL].
